iMailer Licensing and Pricing
In brief:

In detail:
1. All iMailer functionality is controlled by a multi-user FileMaker Pro file named "iMailer" (iMailer.fp5 or iMailer.fp7)
This file responds to iMailer scripts that you run in your file(s), and does all the "work" of creating and sending the iMail messages. To add iMailer functionality to your solution, you simply import a script from one of our Script Model templates into your file (or write your own script, following our designs).
When you add iMailer to your solution, you also add the "iMailer" file to your list of other active FileMaker Pro files. For basic single-user databases, this means simply having the "iMailer" file in the same folder as your existing FileMaker file(s). For multi-user databases (whether they are relational or not), you place a single copy of our "iMailer" file in the same folder where your existing FileMaker files are being hosted.
iMailer works with any FileMaker configuration, including:
* Single-User on a single workstation
* Multiple Single-User on different workstations
* Multi-User, hosted and shared via FileMaker Peer-to-Peer Mode
* Multi-User, hosted and shared via FileMaker Server
* FileMaker Runtime systems (which are single-user by definition)
Like any multi-user FileMaker Pro file, the "iMailer" file can be accessed simultaneously by many users. When you purchase an iMailer license, you are actually purchasing a Registration Code ("RegCode"), that is encrypted with the maximum number of concurrent users allowed to share a single copy of the "iMailer" file.
2. A RegCode can only be used for one copy of the "iMailer" file, in one location
Wherever iMailer is deployed, a copy of the "iMailer" file is setup with one of these RegCodes entered. In most cases, a single copy of the "iMailer" file will be shared across your local network (LAN), and you will only setup and register that single shared (multi-user) copy. To deploy iMailer in multiple locations (on different FileMaker networks or LANs), you need to purchase separate RegCodes, one each for every copy of the "iMailer" file you deploy, and enter a different RegCode for each network.
You may re-use (and re-enter) a RegCode if you are replacing an older version of the "iMailer" file with a newer/revised version, or if you are replacing a deleted/damaged copy of the "iMailer" file. Otherwise, as a general rule, you will only enter a given RegCode one time, into one copy of the "iMailer" file.
FAIR USE POLICY
DATA DESIGNS supports the concept of "Fair Use" as it is commonly applied to intellectual property. "Fair Use" means that you may use this software in a way that fairly represents the license that you have purchased. To us, this applies almost exclusively to Single-User licenses. If you own a Single-User license of iMailer, we would consider Fair Use to include use on a home (desktop) machine and a laptop, for example, as long as the software was not actively used on both machines concurrently.
Using iMailer as a multi-user solution (with a 10-User license, for example) is by definition a "site" license and is therefore not portable and subject to the doctrine of Fair Use. "Fair Use" in a general sense is a consensually agreed upon social contract between the licensor and licensee that is meant to foster mutual trust and reasonableness concerning intellectual property in the digital age.

3. iMailer Licensing is based on concurrent use of a single shared copy of the "iMailer" file
As with any shared FileMaker file, "in use" is defined as merely being open on a given workstation. It does not matter if someone is actively engaging any of the iMailer processes; as long as the "iMailer" file is merely open, it is considered "in use". An iMailer "user", therefore, is someone who has the "iMailer" file open on their workstation.
A 5-User license, for example, means any number of concurrent users (on Macs and/or PCs) up to five, can have that copy of iMailer open on their FileMaker Pro workstations at the same time. If the "iMailer" file (along with your files) are being hosted by FileMaker Server, only the guest workstations can count as a user; FileMaker Server never counts as a user. In FileMaker Pro Peer-to-Peer mode, the Host and all Guests are counted.
If 5 users are simultaneously sharing a single copy of the "iMailer" file under a 5-User Registration Code, a sixth user would be prevented from opening that file (with a dialog explaining why). You can deploy a copy of iMailer with a RegCode for 5 users on a FileMaker network where there are actually more than 5 users of the other FileMaker files (like 20 users of a workgroup solution, for example), as long as the number of workstations that actually have the "iMailer" file open does not exceed 5 at any given time.
A single copy of iMailer can accept different RegCodes. You can buy a 5-user license, register a copy of the "iMailer" file with it, and later purchase a 10 user license, and the iMailer user limit for that copy will be increased when you enter your new 10-user Registration Code into the setup screen of the "iMailer" file. In such cases, the old 5-user code could be used in another system, and remains a valid usable RegCode.
You can also upgrade any user license to a higher number, and only pay the difference between the two licenses. In such cases, the lower number RegCode needs to be permanently "retired" from use. When you upgrade, you agree to discard and discontinue using the lower value RegCode, and you must prevent any retired RegCode from ever being used again, by anyone. Data Designs may seek re-payment from the original licensee for any retired RegCode later found to be activated.
4. iMailer RegCodes cannot be split across multiple copies of our "iMailer" file
See rule 2. An iMailer RegCode gets entered one time, in one place. For example, if you purchase a 5-user code, you cannot use it as a 2-user system in one place, and a 3-user system in another. That 5-User RegCode can only be used in one place, on a single copy of the "iMailer" file (on one LAN), allowing a maximum of five iMailer users (see Rule 3) in that location.
If you have five users in five separate locations, you should purchase a quantity of five Single-User licenses, not a single 5-User License. The price for multiple Single-User licenses is the same as a single Multi-User license for the same quantity of users. For example, 10 Single-User licenses is $599.95, the same price as one 10-User license. 5. Multiple iMailer RegCodes cannot be combined into a single copy of the "iMailer" file
If you purchase a 5-user RegCode, and also purchase a 10-user RegCode, you cannot combine those two to produce a single 15-user copy of the "iMailer" file.
6. iMailer concurrent usage includes all unique (FP5 + FP7) users, up to the RegCode limit
There are now separate versions of iMailer available for FileMaker 7.0 (.FP7) files and for FileMaker 5.x/6 (.FP5) files. You may use a given RegCode with either "iMailer.fp5" or "iMailer.fp7", or with both at the same time, if the total number of unique concurrent users does not exceed the number of users limited by your RegCode(s). Conversely, you may not simultaneously deploy a given iMailer RegCode in separate FileMaker solutions running both "iMailer.fp7" and "iMailer.fp5" in a manner that will result in more total unique concurrent users of iMailer, than are indicated and allowed by the RegCode.
For example, if you have one 5-user RegCode, you could use it with both FP5 and FP7 files, in the following ways:
    3 users of "iMailer.fp5"  AND  2 others using "iMailer.fp7"
    4 users of "iMailer.fp5"  AND  the same 4, plus 1 other using "iMailer.fp7"
    5 users of "iMailer.fp5"  AND  the same 5 using "iMailer.fp7"

HERE ARE SOME EXAMPLES:
Q: "I'm a FileMaker Developer, and I wish to have a copy of iMailer for my own use and to use when developing iMailer solutions for others. I also have 3 clients who could use this now. One has 4 PCs. The second has 1 Mac. The third has 7 PCs and 2 Macs. What iMailer licenses do I need to purchase?"
A: You need to purchase two (2) Single-User Licenses (one for you, one for your client with the 1 Mac), one (1) 5-User License (for the client with the 4 Macs), and one (1) 10-User License (for the client with the 7 PCs and 2 Macs).
Q: "I recently bought a Single-User License, to evaluate how iMailer works with our in-house database. Now, I'd like to increase that 1-User to a 10-User License. Can I do this as an upgrade?"
A: Yes. We will "retire" your Single-User RegCode, and the purchase of the 10-User License will include a credit for the value of the Single-User. The 10-user price is US$599.95, minus US$99.95 for the retired Single-User, means you pay US$500.00 for the 1-to-10 upgrade. To purchase a License Upgrade, contact DATA DESIGNS directly.
Q: "I have 10 users, and each one runs a separate single-user FileMaker database on their computer. Do I buy a 10-User license?"
A: No. You need to buy 10 Single-User licenses, but you will need to call Data Designs to get the bulk price discount, so your final cost is the same as one 10-User license ($599.95).
Q: "I bought a Single-User license, and received a bonus 2-User license for being at DevCon 2003. Can I run iMailer on my network with 3 users?"
A: No. The DevCon special gives you two separate licenses, that can be used for two separate iMailer installations. As explained above, you cannot combine (or split) iMailer licenses. You can keep either license and transfer the other to someone else. You can even sell one or both licenses, provided you have never registered them. The idea was to give you a 2-User license for your own use, so you could setup a test using a Mac and a PC at the same time, and whatever other license you purchased was intended for a pending client of yours.
 
iMailer Pricing (in US Dollars)
These use a single RegCode per license, for shared/multi-user FileMaker networks. For example, a 5-User license will take the form of a single RegCode, to be used on one shared copy of the "iMailer" file (.fp5 or .fp7).

Bulk Pricing is available for Single-User Licenses only. If you need to deploy iMailer on multiple stand-alone systems where only a single iMailer user is required with each system, or if you are running a single-user FileMaker solution on multiple workstations on the same network, you can purchase iMailer Single-User licenses in bulk, at pricing that is equivalent to our multi-user licensing. These bulk licenses come with multiple Single-User RegCodes (a 10-PACK includes 10 different codes, for example), and pricing is as follows:

If you are distributing a FileMaker Runtime solution, you can now easily include integrated iMailer features with your solution. A separate iMailer Single-User license and RegCode would be needed for each of your end-users who wish to use the iMailer features. You may purchase iMailer Single-User licenses at the above pricing and then resell them to your end-users. Or, your end-users can buy iMailer Single-User licenses as needed from our website. Each of your end-users would be required to enter a unique iMailer RegCode, to activate the features.
We are also planning an iMailer Runtime Unlimited version, which will allow an unlimited number of copies of your solution to be distributed with iMailer, for a one-time fee (TBA). This version will have single-user access pre-configured, and no iMailer "RegCode" is required to be entered by your end-users.
